When is self defense a valid defense?

The situation and I’ll try my best to include all known facts and leave out all the hearsay. A 30 year old neighborhood watch lead (Zimmerman)with a conceal and carry license spots a 17 year old youth (Martin) walking in his neighborhood. He follows the youth in his car “for awhile” until he calls the police to report what he believes to be a suspicious individual. The police tell him not to follow the man. Meanwhile Martin is on the phone with his girlfriend telling her that some strange man is following him in a car. She tells Martin to run. Zimmerman leaves his vehicle to prosue Martin on foot. At this point a physical altercation breaks out. Nobody knows what was said or how the altercation started. It appears Martin gets the upper hand in the fight while Zimmerman is on the losing end. Zimmerman pulls out his pistol and ends the fight. The police arrive, take Zimmerman into custody and after questioning release him.

I’m a believer in protecting myself and have many friends with conceal and carry licenses. I’m working on getting my own.

Typically if you kill a man and the police let you go they truly believe your story. Nobody knows what exactly Zimmerman said to the police nor have the police released a detailed statement.

The problem. If Zimmerman had just left Martin alone this wouldn’t have happened at all. If Martin was “beating” Zimmerman’s head against the ground as he claims then he had every right to defend himself.

I have a few hypotheticals for this situation.

1. If I walk into a bar and someone picks a fight with me and I shot them with my gun should I get arrested for murder?

2. If I walk into a bar and pick a fight with someone and when I start to lose that fight I pull my gun out and shot, should I be arrested for murder?

3.If two men with CCW get into an altercation and both pull their weapons and kill each other, who is at fault? According to the stand your ground law it appears that neither would be at fault.

3. What if Martin had a gun and shot and killed Zimmerman in self defense?

This last question is an interesting angle because I feel Martin would have more cause to shot or defend himself because he was the one being followed. It would have been his words against a dead mans which always seems to be the winner in any debate. Even if you believe Zimmerman was being “beaten to death” and fired in self defense how can you justify him following Martin, leaving his vehicle and getting close enough to get into a physical confrontation? BTW when you take a conceal and carry class they teach you to avoid conflict, flee from danger and only lose your gun as a last resort. Was Zimmerman following these practices when he left his vehicle and followed Martin on foot? Its a simple answer and the answer is NO. Sadly if Martin had shot Zimmerman I’m sure he would have been arrested on site and already been put in jail as another black gang related crime.

Do I believe Zimmerman should be charged with murder? If he was truly defending himself then no. That seems to be a hard argument to make. I do think he was in the wrong and his own poor choices led to this horrible situation. I also believe he should lose his CCW.

A personal note. When I was13-17 years old (around Martins age) I had long dyed hair, wore a black trench coat and rode my skateboard. Back in the early 90′s in the mid west riding a skateboard made you a black commie transvestite and you were always in season to be picked on, assaulted or even killed. I remember numerous occasions being followed by cars full of football jocks looking for a fight. Many of these occasions they would follow me until I found a backyard to duck into. Sometimes they’d get out and case me, surround me (and my friends) and push us around. On the most extreme cases they would hit us, throw us to the ground and try stomping on us. We learned very quickly that if they got out of their cars they were serious and we would use our skateboards to defend ourselves. I personally never had the pleasure of hitting someone it the head with my skateboard but I saw it happen many times. I remember one night I broke my skateboard in half and was walking home alone late at night. A car with two large meat heads slowly followed me for about a hundred feet while the driver yelled “hey you stupid faggot skater! get a haircut you fucking faggot! I’m going to blah blah blah…”

Ignoring this wasn’t getting me anywhere and the road I was on didn’t have any houses or side streets for escape. I turned and said “get out of the car and kick my ass then” The car door opened and as soon as the drivers foot touched the ground I kicked the car door closed on him. He screamed in pain and I ran in the opposite direction. What if I had beat him for while and then he pulled out a gun and shot me? Would I be another victim in the wrong place at the wrong time? Did I deserve to die because I was being followed and threatened so I decided to defend myself? According to most of american it looks like the answer is yes.

Abortion, rape and incest oh my!

I’m sick of the debates from both sides of the fence about abortion.

Here is the deal, when you make it a civil rights issue one can argue from the side of the mother (her rights need to be protected) or the rights of the baby! (they got rights too!)

If you think abortion is murder then it doesn’t matter if the bitch was gang raped by dad, brother and grandpa. It’s still a child (not one that she wanted) and if you abort it then its still murder.

So really using the argument of rape and incest doesn’t fucking matter to a Pro-lifer. A life is a life.

If the pregnancy is going to fuck the mother up then she and the doctor should be able to terminate! If you outlaw abortion then you deny the rights of the mother!

So here is a sane answer to when a woman can/should be able to abort.

Life does not start at conception and here’s why. You can’t call a cluster of cells (even living ones) life.
We don’t declare death once every cell in your body is dead. We declare death once heart beat and brain ceases in the body. When a sperm hits an egg there is no heartbeat or brain activity. That doesn’t happen until a few weeks later in the pregnancy. How can we call that life when we couldn’t declare it dead yet?
If I shoot someone in the head and kill them should we not declare them dead until rigamortis has set in and all their cells are dead? It’s a real slippery slope calling conception alive.
I know Pro-life people like to call a fetus alive and get laws that prosecute for two lives when the woman and fetus are killed.
How about we start passing laws against murder because the bullet didn’t kill that man, it was all his cells dying that killed him.
Sounds pretty stupid when you reverse it doesn’t it?

Until that cluster of cells has a heartbeat or brain activity then it’s not a fucking fetus yet nor can you declare it alive. After the point in the pregnancy it grows a heart and brain then maybe you can start calling it alive but it’s still shaky grounds because of it’s dependency in the mothers womb. Go ahead call it alive after so many weeks in the womb, now will we start prosecuting mothers with involuntary manslaughter when they miscarry?

Dear Rush, I won’t address you by your last name because that would be too formal. I wish to comment on your remarks calling Sandra Fluke a slut and prositute for her comments on a government mandate for birth control.

Now most know I’m pretty much a libertarian and disagree with any government mandates. Calling someone a slut for asking for or using contraception is the best thing I”ve heard all day. I guess it takes one to know one coming from a guy who’s cheated on his wife and who’s mouth will do anything for a dollar. Let’s analyze this closer, Sandra’s statement is (and I’ll summerize) if we’re going to mandate coverage then we should include birthcontrol. That’s it, nothing more and nothing less. We could state that birth control pills help women with ovarian cancer and regulate cycles which save more money in the long run but I’m just going to leave it at my first statement.

Rush and most of the Fox news team say they don’t want to pay for people having sex. The connection of a birth control pill and having sex is a weak one at best. The irony is Viagra and Cialis are covered already and I don’t hear these hypocritical fuckers up in arms about that? Viagra is a drug that gives you a erection for sex. Maybe some guys just want to run around with a hardon but 99.9% of the time its for sex. Birth control is a pill that regulates a woman’s menstrual cycle. Polls say 98% of Catholic women already use “banned birth control substances” while only 60% of american women are even sexually active that are on birth control. That leaves millions of women on birth control that are not sexually active. Which one is really dedicated for sex, birth control or Viagra? These same folks don’t want to fund planned parenthood and are the first to complain about the under privileged sucking government entitlements. Does anyone see the irony there?

If you fund contraceptives then you won’t have as many abortions nor will you have as many “under privileged.” What an amazing concept. Not part of you religion? That’s ok because whether or not you choose to use birth control under your plan doesn’t effect the cost of the coverage! In fact it might cost more for insurers to create a plan that negates all contraception due to the additional paper work. If someone at your church chooses to get birth control from your TAX EXEMPT organization’s coverage then maybe you should give them the boot? Or maybe we should stop churches from being a taxed exempt organization and make them private clubs so the government isn’t involved at all.

Problem solved.

I don’t agree with the government mandate of forcing people to buy or provide health insurance, but if we’re going to do it anyway then all forms of health insurance should be covered. If I’m forced to buy then I better have access to everything because I’m fucking paying for it. If you do not wish to exercise your right for Birth Control then so be it. The cost remains the same regardless.

Dear government, please vote yes on SOPA and all internet cencorship bills. I’m not sure what the movie and music industry would do if they couldn’t arbitrarily have the government shut down any and all sites for them. I really worry about those two dying industries and hope the gov can extend their life though eliminating the competition and lawsuits. That would be great!
On another note I particularly love NDAA with indefinite detention and the healthcare bill that mandates everyone to buy healthcare. Those two are the best. I was starting to feel bad for my insurance company. I mean how could the american people consider robbing the healthcare industry of their dues by going uninsured!
I think our judges and lawyers are overwhelmed so not giving people proper process should free them up for more family time and golf.
I also think North Korea and Iran have yellowcake or some form of threat that we need to intervene on. I’m sure our military doesn’t have much to do anymore since we won the war in Iraq and use unmanned drone strikes in countries we’re not at war with. A two front war between Iran and NK would keep our military on their toes and show the rest of the world our pride and strength. If they’re not with us then they’re against us and we can bomb them too.
Finally is there anyway I can pay more in taxes. I hear our government has to keep raising its own credit limit and keeps borrowing from China. This is terrible to hear and I want to do my part as an american to take care of the government that takes care of me.

Obama, Democrats and Hope. What changed?

So I really didn’t care for G. W. Bush. I was right up there with the Left wing media chanting about how Bush will be the demise of the United States and compared him to Hitler. I hated the bullshit reasoning for invading Iraq before it was cool and hated his hick accent.
Do a search on “why do people hate Bush” and you’ll read a litany of things that more then 50% of America hated about the man. In fact some of my conservative friends didn’t have high opinions of the man either but it wasn’t for the same reasons the liberals hated him. Conservatives hated Bush for being too Liberal. Oddly enough the Patriot Act and Iraq war didn’t sit very well with a large portion of the conservative voters. This was evident by the onslaught of votes for Obama wiping the entire government almost clean of most seated Republicans.
This was also evident in the inception of the Tea Party movement which was fed up (not with Obama) but with big brother pissing in their cool aid. (Disclaimer: The Tea Party has now been hijacked by “Value voters”, Fox News and Sarah-I don’t believe in dinosaurs-Palin) It sucks because they didn’t start out that way but anytime you have a conservative movement every God Bombing Jesus Fuck puts their dick in thinking it was welcome. Sorry “True conservatives” don’t want the government to impose their morality onto others. That’s the exact opposite of everything they stand for. There really isn’t difference between telling gays who the can and can’t fuck or telling a fat fuck what he can and can’t eat. It’s all Government interfering in our freedom to be stupid, fat and pissed off. True Conservatives don’t want either. Listen to Doug Stanhope and you’ll hear the crudest atheists conservative doing the best stand up you’ll ever hear.
Back to all the bullshit Bush pulled on America. We all know that Iraq wasn’t doing shit to us nor did it pose any threat. If you still think Saddam was hiding WMD’s then go fuck your mom in the throat so she doesn’t give birth to anymore of you.
We invaded them and fucked their county up really bad. That’s what happens when you wipe out an entire government along with their police force and military. It’s anarchy in its truest form and human nature isn’t pretty. Although I did respect a lot of the stories I only heard on NPR about how the Iraqi’s came together here and there to kick out the extremists.
Anyway I really didn’t like the war but kinda felt we needed to stay there for a bit while the Iraqi people got their shit back together. It would be the least we could do after the shit storm we brought.
I never supported the war I only thought we should keep a military presence to keep the peace during a civil war/religious genocide. You know, those little things that only an Abrams Tank will deter people from doing.
When I heard the Democrats all voted for the war I gave them a pass because that idiot Bush lied to them. Guess he wasn’t so stupid after all.
Right at the tail end of his second term we had the second coming of liberal Christ and his name was barack obama. He spoke of hope and change, hope and change. The god damn speech was good. His emotion and timing won over even the most jaded independent voters.
Before Bush would leave office he’d leave us with one more gem of a motion which was bailing out the banking establiments on the pretense they were too big the fail. Once again the demcrats cried foul and conservatives rolled their eyes while yelling “get the fuck out of office you liberal!”John Mccain the old white nutty POW with his terrorist accusing side kick Palin didn’t stand a fucking chance against a well spoken black man with so much charisma seeping from his him his fucking shoes squeaked with charisma juice. 90% of all black people in america freaked out and voted. 5% said he’s be killed before making a difference and the other 5% where republican.
All the people, democrats and independents swarmed to the voting booths with visions of sugar plums dancing in their heads.
I remember comparing Mccain and Obamas stances one the tops issues. They weren’t that far apart on a lot of them so it was hard for me to vote for Obama be default out of my hatred for Bush. Here is the list and I can provide many a link to back these fuckers up.
War in Iraqi (and war on terror)
M – troops out by Dec 2012 and keep killing anyone who doesn’t like America.
O- troops out 16 months after day 1 and use common sense and compassion with the world
Patriot Act
M – I’ll have my people look at it and we’ll think about limited it a little
O – That fuckers is getting repealed.
Gay Marriage
M – I’m a republican so I have to turn my back on my gay daughter for my party.
O- Let all gays suck dick in church!
Tax Reform
M – continue Bush tax cuts for rich while simplifying the tax refund form.
O – stop the Bush tax cuts while letting the government tell you want you owe and you only fill out the form if you disagree. (that’s one way to simplify it!)

Bail outs
M – They are too big to fail but we should limit it to just a few.
O – I don’t like voting for this but if the shit hits the fan you can’t blame me.
Healthcare reform
M – Health insurance companies need reform but I forgot what I was talking about because I’m old
O – Universal healthcare for all and to all a good night!
War on Drugs
M – Just kill the Junkies and we won’t have a problem
O- We need to start putting criminals in jail and not make criminals out of ordinary people with our drug laws! (woo hoo muthafucker I’m onboard!)

Mccain actually wasn’t a big hit amoung the republican party because he sounded like an Atheist and downplayed Christianity. Knowing this would lose him votes he took Palin on to pander to the Christian Right and you my friend have now lost my vote. Ron Paul was in the mix but I wasn’t too sure about him either. I knew he was adamantly against the Iraqi war so I wanted to give him my vote just on that alone. The Republican party had him removed from the ballot using very shady means expecting any Ron Paul voters to default back to Mccain. This only incdnsed me so out of spite I voted for Obama. Not only did I vote for him but I jumped on his nuts and gave them a big hug. I drank the Cool Aid of Hope and Change and thought if nothing else I’ll still get what I want.
Lets recap on those campaign promises now.
War In Iraq
O – Pulling troops out Dec 2012. I won’t give him a pass on this because not only was he not trying to pull the troops out his cabinet was negotiating every day with the instilled Iraqi government to stay longer. He only started to pull them out when the Iraqi government said fuck off and leave. now we’re attacking more countries without even throwing towards congress for a vote. Bush paved the way for any military action without justification. Not even sure if this is a complete flip flop by Obama or just him realizing that he was a warmongering fuck just like Bush.

Patriot Act
O- not only was there no attempt to repeal this, his cabinet has expanding on it. Democrats now support it and the left wing media no longer covers it. Between the Patriot Act and the war I thought Hippies were turn violent against the government! Now where are the protests?
Fuck off with your change and hope and why am I the only one who’s mad about this?
Why aren’t demcrats pissed off and why aren’t warmongering republicans praising this guy?
I’m fucking perplexed.

Gay marriage

Bush tax cuts and Tax Reform
Well he did try to expire them but really just passed a compromised version of it.
As far as the simplified tax form he did nothing. I don’t care if you were for or against his version of the form. He did nothing which means he’s happy with they way you do your taxes. Flip flop again or just didn’t deliver?

Bail outs
O- not only did he bail out the big evil banks that the occupiers hate so much. he and the government went out to bail out Chrysler , GM, Harley Davidson and Mcdonalds. Yes Fucking Mcdonalds got your tax dollars. Eat that hippie-vegan-liberals.Then Obama put half of the fucking bank lobbyists on his panel to write new regulations that prevent bankers from going to jail after they fuck the country and steal your money. Eat that Occupiers hippie vegan… I lost track of how many people he should have pissed off at this point.

Healthcare reform
O – Everyone now has to buy the healthcare they can’t afford otherwise they have to pay a penalty at the end of the year collected by the IRS. If you don’t pay this penalty then you’re a tax evader and go to fucking jail.
Somehow the media plays this off as the poor get free healthcare and the rest of us just pay a little more? WTF? Sorry I have some poor ass friends that have been unemployed since Bush’s era. They’ve read the fucking bill and they’re not getting anything.
This isn’t socialist. This isn’t even a flip flop. This is pure corporatism when your force me to buy a service from a company that I don’t want. Corporatism is closer to fascism then socialism so fuck off tea party fox news fucks. Get your terminology right! There is nothing socialist about his bill and I’m almost more annoyed by hearing the term socialism get thrown around incorrectly then I am about the bill itself!

War on Drugs
O- now most of the medical marijuana dispensaries who are completely legal under state law are getting raided by the Feds. no reform in site. Suck that hippie liberal pot head blah blah…

So someone please tell me how Obama hasn’t pissed off the Democrats and why the republicans don’t love this man?
Any Democrat that likes Obama is a fucking hypocrite if they actually look at the issues and supported him during his campaign. He not only flip flopped on his top issues he did worse then Bush.
Any Republican is a fucking hypocrite anyway but if they were war mongering, gay bashing big banker nug hungers then Obama has pretty much done what they wanted or at least hasn’t gone against their agenda.
Now hearing arguments from all my friends I do agree with the points about “common sense” regulation and getting the religious morality out of the picture. I’ll tote the liberal hippie flag with the best of them but Fuck this. These last 20 years I’ve seen nothing but shit from our government and bullshit arguments about why each side sucks. The arguments aren’t even valid which makes the whole thing a pile of shit. If people were as critical of the stuff they think they stand for as they are for the stuff they hate. I think minds would start to open and the curtain would finally be pulled away.
I don’t know how else to spell this out. Bud and Bud light. Democrats and Republicans. There is no difference and they’ll never be any change.

I’m not trying to be a downer or even kill anyone’s dream of a Utopian society. I’m just telling it like it really is without all the media bullshit and two party brainwashing.

Liberal vs Conservative

What do these words mean?
Text book definitions are pretty straight forward.
Liberal means more and conservative means less.
Use them in a sentence. Please give me a liberal helping of mash potatoes. (Any normal sane person would give me a lot or more. )
or Please give me a conservative potions of mash potatoes. (Any normal sane person would give me a tiny bit. )
Now in the context of political stance or which side of the political spectrum you side they really don’t mean more or less anymore. Some say Liberal means Progressive and conservative means status quo. Other terms I’ve heard are big gov vs little gov.
None of these makes sense when applied to the Democrat or Republican parties though.
So then you have to consider what issue and how each party falls on that issue.
Take gay marriage for instance. People would generally agree that Democrats are “socially liberal” and would like to see gay marriage whereas Republicans are “social conservatives” and want to see all gays burn in hell. So what the fuck does the term socially liberal mean? If liberal means more then I’d expect the government to want to regulate who can and can’t get married to be socially liberal. This is not the generally accepted view point!
Socially progressive makes slightly more sense but I still don’t make the connection to how that term means more accepting of alternative life styles!?
So I’m left completely confused as to why Liberal and Conservative doesn’t always mean “more government” or “less government.”
If you take the opposing stances of the two parties you’ll find they really cherry pick what issues they’re liberal and conservative on. The Democrats are not the “liberal party” and the Republicans are certainly not conservative. Unless the definitions of these words are so skewed that no relavice still applies to being more/less/progressive/status quo whatever.
The more I try to wrap my head around the terms “political terms” of liberal and conservative the more confused I get.

If the Republicans are the “conservative party” then how can war be a conservative thing when direct military intervention is about the most government you can have?
How can passing laws on who I can and can’t marry be less government? It can’t! it’s more! So should we call it liberal?
Now I can sway any republican into renouncing their party as long as they’re not religious nut jobs that think the government needs to regulate their morality on others. It’s simple I just say conservative means less government right? They says yes and then I show them how the republican party is anything but that. They understand and see the hypocrisy pretty quick when a republican says they want small government but support the patriot act, war on drugs, ban on gay marriage or support war. (disclaimer as long as they’re not a religious nut case this works)You can’t say you’re fiscally conservative and support the war/bail outs/bloated government agencies/redundant government agencies/raising taxes and even supporting the 911 victim fund. (Yah I went there.)
All those things are liberal spending themes that grow the government. Not saying they’re good or bad I’m just saying they’re all, MORE.
Funny as a liberal you can support the war and by text book definition not be a hypocrite because war is more government. This didn’t jive during Bush’s career when more then half of America took issue with the Iraq war. Most of the democrats cried foul when the GOP ate some Yellow Cake and went to town. I almost wonder if they(the democrats) did it because the people were upset, or if they wanted to make the people upset (because the democrats all voted for it at the time) or if they truly felt slighted by good ole boy Bush?
Don’t know but my point is war is not conservative in any form. Most of my republican friends would agree that Bush was a “Progressive!” Funny… I thought he was so far right/conservative that there would be no way anyone would think he’s a liberal or progressive. I thought that would be so solid that nobody could disagree yet here was in-front of me. Bush sucks because he’s big government. WTF just happened!
To this day I don’t know what the terms Liberal and Conservative actually mean in the context of politics.

13-Year Old

Most people are upset because the victim is only 13 years
old. The law says this is considered rape or whatever legal term they choose to
put on it and the woman is getting charged with the crime. If you look up this news article you’ll find it everywhere. Any website with comments enabled will range from hilarity to anger. I won’t get into the whole the victim is a boy and she’s a woman which makes it better or worse.

What I want to focus on is some of the comments from Christians. Most of them are up in arms about the
situation and the boy’s age. Some posters point out the irony of her being a bible camp teacher while others stick with the age or sex role reversal.

That said if we look at history in biblical times 13 year old boys were considered late teen and men by 15-16. In ancient Asian cultures 13 was the age of emperors with 5 wives.

“BUT JUSTIN WE’RE NOT LIVING IN BIBLICALTIMES!”

Yes but the one comment I haven’t seen on any of these threads is she’s committed adultery which is the only sin listed in the bible that’s she’s committed. The bible doesn’t address anything about cougars taking
advantage of younger boys for Christ’s sake! I find the oddest things to be
annoyed by but the fact that not one Christian has addressed this bothers me.
The fact that not one person has brought up the point that she’s destroyed her
marriage and family bothers me. If you’re a true Christian then the age shouldn’t really fucking matter because it’s really just a cultural thing that makes us believe it’s an issue. The only
piece that is against god is the adultery part.

As much as I think its wrong I’m pretty sure the kid is
going to be OK. If he was one of the Penn state victims getting ass raped by
the coach or if it was a little girl getting ass raped by an older man then yes
they’re going to be pretty fuct later in life. As it is I think the kid won’t
understand how messed up it is until he’s old enough!

The woman’s son and husband on the other hand will have to
deal with her being in jail for the rest of her life. Her family are victims
and will more than likely suffer way more than the little boy.

New Batman Movies/Christopher Noland

I just finished watching Warrior for the 2nd time. After the movie I was researching Tom Hardy’s acting career and came across a forum about his role in the new Batman movie. He’ll be playing Bane who is the over muscle bound nemesis who breaks Batman’s back. In this forum I read a lot of comments about Tom Hardy not being big enough to play Bane blah bah. Let’s stop here for a minute and reflect on Dark Knight. I remember when Health Ledger was announced as the Joker all the comic forums across america exploded. You could’ve sworn that fat zit faced fan boys were posed with pitch forks and torches outside of Christopher Noland’s home waiting to strike at the first sign of Batman sacrilege.

What happened after Dark Knight was released? All the Fan Boys shut the their fucking mouths and the rest of us truly embraced any choices Noland makes with actors or plot. Not only did Health Ledger give us the most menacing Joker to ever hit the big screen. Heath delivered the best performance of his career.

Now back to Tom Hardy as Bane. Hardy isn’t that tall but is ripped like a greek statue. Somehow all these fan boys have missed Bronson? Where Hardy trained with a personal trainer for 6months to bulk up his frame losing some of his cut for mass. This was to simulate the body of an inmate that doesn’t have weights to work out with. Yah he looks like a fucking monster in that movie. Put Bronson in instead of Bane and Batman doesn’t stand a chance.

Hell put Christian Bales character “Jim” from the movie Harsh Times and the bad guys would really be scared. That’s what I want to see. Jim vs Bronson in a mega fight to the death. I’m getting off topic now.

Hardy’s performance in Warrior is awesome. His physique shows muscles where most of us don’t have any. He could flex one of his gorilla shoulder muscles and make a guidette cry. With forced perspective they can add a little height to him and let him roll with it. What I don’t want to see is another bumbling fool in a foam muscle suit making retarded grunting noises like we saw in Batman and Robin. At this point I can’t see anyone else who could play this role better or any other director pulling it off.

What if they change the name of their game from “Scrolls” to “Fuck You, Bethesda”?

Okay … so some backstory. A little indie developer called Mojang creates this little game called Minecraft. It sells a few (i.e. million) copies and becomes a relatively (i.e. wildly) successful indie game. Back in the early days, the developer trademarked the name Scrolls for a game idea they had for a future title. Scrolls. That’s it. Not “Elder Scrolls”. Not “Younger Scrolls”. Not “Scrolls, as in Oblivion”. Just … Scrolls. You know what I think of when I hear the word scrolls? Not Oblivion, Morrorwind or any other game Bethesda made in the Elder Scrolls universe. I think of rolled up pieces of parchment containing old-ass words that only over-educated, underpaid, self-righteous nerds could even pretend to know how to read. You know, those things that have been around for thousands of years. Oh yeah, Scrolls will be an indie developed card game, not a wide open-ended RPG in a massive world with an enormous budget and overpaid top tier voice talent.

Mojang has been trying to be nice about this by heaping copious amounts of praise upon the work of Bethesda over the years (and rightfully so) but Bethesda are continuing to play the role of dick puncher. Mojang even threw out the idea of a Quake 3 Deathmatch for the rights to the trademark but was again served up a nice heaping dose of douch-fluid from the lawyers at Bethesda. So now they go to court.

I hope Bethesda gets decimated by the judge on this one. The name Scrolls shouldn’t even remotely be considered infringing upon Bethesda’s trademarks. With any luck, the judge will read the claim, snort and tell the Mojang fellows to walk over to the Bethesda lawyers and bitch-slap them before handing out the victory to Mojang.

I’d also like to add … Minecraft gameplay is infinitely more engaging than Oblivion was. And I loved Oblivion, shitty character graphics and all.

With that said, how do I get a refund on my Skyrim pre-order. I don’t want to support your company until you drop this stupid nonsense and issue a formal apology to Mojang for being dickholes.

The wonderful world of Sprint and undisclosed fees

Went to the Sprint store to upgrade my POS samsung moment to get the new Nexus S. Somehow someway the online price was completely different then the “instore” price. The manager comes over and works with me to get the price down. He asks if I’d be willing to trade in my old shitty samsung moment. Knowing I’d have to deal with psycho’s on craigslist just to squeeze another 50 bucks outta my selling price I thought “fuck, just take it.” He said the trade-in was final and that I couldn’t get my phone back. Puzzled I said, “why the hell would I want that POS back?” The manager replied, “you’d be surprised how many people come back in here wanting their old phone back.”
With no elaboration I figured people are creatures of habit and just like what they’re used too.
We complete the transaction and I fall in love with my new Nexus that boots in seconds, has 10Xs the internal memory, plays Netflix and pretty much kicks the Moment in the dick.
He informs me that my next bill will have an activation fee on it for 20bucks. I say, “SURE NO PROB! SEE YA LATER!”
I get my bill. Not only does it have a 20 dollar activation fee, it also has a 9.99..Fuck Lets just call it a 10 dollar Premium Data Plan fee. I quickly go back to last months bill and realize this is a new fee. *2 and I’m on the phone with customer service. The nice lady explains to me that every since April 2011 they’ve been adding this 10 dollar fee to every smart phone activation. I didn’t see it before because I’d had my smart phone for 2 years before that fee took affect. I tell her that the store made no mention of this fee which would’ve swayed my buying options. She says “Sir you’re still within your first 30 days you can return the phone.” Sure I can return the phone but what the fuck do I do then? I can’t get my old phone back…Wait…the dude said “You’d be surprised how many people come back wanting their old phone back.” Now I know why. Their getting a 10 dollar rape fee for fucking changing phones! My options are take it in the ass for the next 2 years, paying an additional 240 bucks for having essentially the same fucking smart phone or return the god damn thing and get a brick in a bag from the 1980s!
I slam the phone down hard on the sprint CS rep. Now you say “Justin, its just 10 dollars?”
Its 10 dollars to sprint. It’s 2 dollars to the ATM. It’s 4 dollars back to my bank for using the damn ATM outside my network. Its 15 dollars to ticket master. Its fucking 1 dollar more to Ruchi Indian Buffet..I’m getting nickle and fucking dimed right out of the middle class! Can I apply for fucking food stamps or government aid yet? No because I make enough money to give half it to the government and the other half to these fucking crooks 1 dollar at a fucking time. Why not just bill me the whole amount all at once so I can plan for this shit?
I’ll tell you what. I’m typing a line of dashes in the digital sand. I’m taking a hypothetical stance against a audacious world of fees and up charges. I got my phone and I’m going to hate loving it.
